LUC’s libel suit against FMT resolved

PETALING JAYA: A libel lawsuit taken out by Lincoln University College (LUC) against FMT scheduled for hearing next month was amicably settled in the High Court here Tuesday morning by the recording of a consent judgment.
As part of the settlement, FMT tendered its apology to LUC for several statements published on the portal which were likely to be construed in a manner defamatory to LUC.
“The Articles were not intended to convey that LUC was guilty of any form of wrongdoing and/or in breach of Malaysian Laws,” the apology read. “We apologise if the articles did convey any such meaning.”

LUC was represented in Court by Parvinder Kaur Sandhu, while Clement Lopez acted as counsel for FMT.
The author of the impugned articles, former FMT journalist B Nantha Kumar, however, was not a party to the settlement.
As a result, the trial between LUC and him is scheduled to begin on April 3.
FMT CEO Shahrom Shahrudin explained that the settlement was agreed upon in the interest of resolving what was another “legacy” case inherited by its present management.
APOLOGY AND UNDERTAKING TO LINCOLN UNIVERSITY COLLEGE
Pursuant to the terms of settlement reached in this case, we hereby tender our unconditional apology to Lincoln University College for all statements in articles previously published on our Free Malaysia Today portal which were likely to be constructed in a manner defamatory to Lincoln University College.
The articles were not intended to convey that Lincoln University College was guilty of any form of wrongdoing and/or in breach of Malaysian laws.
We apologise if the articles did convey any such meaning.
The articles have been permanently removed from our website.
We undertake not to publish the said or similar statements concerning Lincoln University College in the future.
